Cash-out value for unused holiday (Urlaubsabgeltung)
When the employment ends and you have unused statutory holiday left, the employer must pay it out in cash (§ 7 (4) BUrlG). The pay-out equals your average daily wage × untaken holiday days.
Forfeiture warning. Holiday no longer forfeits automatically at year end. The CJEU (Max-Planck judgment, C-684/16) requires the employer to warn you about unused holiday — otherwise it carries over. The Urlaubsabgeltung claim itself becomes statute-barred 3 years after the end of the calendar year in which the employment ended.
